Delayed Flight Claim


If your flight was delayed, causing you to arrive at your destination more than three hours late, you may also be entitled to claim delayed flight compensation. Under UK law, passengers who have experienced delayed flights in Manchester – or anywhere in the UK, anytime in the last six years are eligible to claim compensation.

What Compensation Am I Entitled To?

If you have experienced a delayed flight, the airline must offer you options to compensate for the inconvenience caused. What you’re entitled to depends on the length of the delay. Such compensation is outlined below.

A Delay of Two or More Hours

If your flight was delayed two or more hours, your airline has a duty to compensate you in the form of vouchers. Passengers are entitled to the following:

  • Food and drink
  • Access to phone calls and emails
  • Overnight accommodation (if passengers are delayed overnight)
  • Airport transfers

It’s important to know that not all airlines are forthcoming with what passengers who have been delayed for approximately two hours are entitled to. If your airline did not offer you vouchers for any of the above, keep receipts. You may be able to claim compensation later.

Additionally, alcohol, expensive means and luxury accommodation are not considered by airlines to be ‘reasonable expenses’ and, as such, cannot be claimed back.

A Delay of Three or More Hours

Once a delay exceeds three hours, you have a legal right to claim compensation – providing that the delay was not caused by ‘extraordinary circumstances.’

A Delay of Five or More Hours

If they flight is delayed for five hours or more, you are under no legal obligation to take the flight. This is true, regardless of the circumstances surrounding the delay.

Not Taking the Flight

If you choose not to take delayed flights in Manchester – or anywhere in the UK – the airline is legally required to provide you with the following:

  • Full refund for the flight
  • Full return and connecting flight refund
  • A return flight, if the delayed flight is the connecting one
  • Food and drink
  • Access to phone calls and emails
  • Accommodation and transfer, if you’re delayed overnight

Taking the Flight

If you choose to take the flight, you can still claim compensation, providing that the delay was not caused by ‘extraordinary circumstances.’

HOW MUCH COMPENSATION CAN I CLAIM FROM THE AIRLINES?

The flight compensation amount is set by the EU Law, EU Regulation 261/2004. The amount will be based on the length of the delay and the flight distance. They are not related to the cost of your ticket, so whether you paid £50 or £1000 for your ticket, the amount of compensation stays the same.

Regulation (EC) 261/2004 states that all airlines should compensate passengers if a flight is heavily delayed or cancelled. They must also offer meals, refreshments and hotel accommodation (if appropriate) while you wait for a rearranged flight. It is the airlines duty to cover the transport costs between the hotel and airport, regardless of the costs incurred.  If the airline does not provide this service then keep all receipts so that you may to claim reimbursement from the airline.

Yes. The passenger is the only person who would be entitled to claim, not the person who paid for the ticket. (Unless that person was with you, in which case you would both be entitled to claim).  Provided the ticket was purchased and paid for and was not free.

Under the English law there is a time limit of six years to claim, so you cannot claim any further back than flights in the last six years.

If your flight departed more than three hours late but landed under three hours late by making up lost time in air within the journey, then you are not entitled to compensation. But if the flight departed and arrived more than three hours late then you are entitled to claim.

Airlines refer to an ‘extraordinary circumstance’ as anything unexpected or outside of their control and they do not have to pay compensation if your delay was caused by “extraordinary circumstances”.

The following situations are considered extraordinary:

  • Industrial action: Strikes by ground staff and/or air traffic control
  • Political circumstances: Terror attacks, political unrest, security risks
  • Weather conditions: Heavy rains, snow, storms etc
  • Illness: Sick crew member or passenger
  • ​Delays caused by the airport staff (long queues during security checks)
  • Security risks

Technical faults do not count as examples of extraordinary circumstances.

It is impossible to give a 100% exact time scale on settlements as each case is different. Claims vary from as quickly as 2 weeks to as long as 8 months.
