What is Mercedes alleged to have done?
Recently, the KBA (which is the German road vehicle authority) found that Daimler, the parent company of Mercedes, had used certain software which altered the diesel emissions of certain vehicles. It ordered Mercedes to recall the affected vehicles and the German courts went further than this and concluded that Daimler have been using a prohibited cheat device. This is a major finding and similar to the recent VW case, in which the UK courts found that the ruling of the German court applied here.
The software affects vehicles which use add blue in the BLUE Tech vehicles to reduce the amount of air pollution created by a diesel engine.
We believe that owners of affected vehicles could be compensated because essentially these vehicles were mis-sold, having been advertised as being more environmentally sound with lower NOx emissions. Increased NOx emissions are harmful to the environment and in turn society in general.
Is this real and why is it possible to make a claim?
Yes, it is real and Versus Law are investigating a potential group claim against Mercedes-Benz and it’s parent company Daimler. The claim stems from an alleged ‘cheat device’ fitted to certain vehicles. The purpose of the alleged cheat device was to reduce emissions artificially so that the vehicles would pass EU emissions tests. We believe that software of this kind and in particular a large corporate organisation behaving in this way is against UK law. As such, we are planning on bringing a legal claim for compensation on behalf of consumers who own or owned affected vehicles.
