Mercedes Benz Emissions Case
Mercedes-Benz is under investigation for allegedly installing illegal emission ‘defeat devices’ to hundreds of thousands of its diesel cars and vans, used to cheat emissions testing and limits laid down by Regulations imposed by law.
In 2018, the German Federal Motor Transport Authority, Kraftfahrt-Bundesamt (KBA) forced a recall of 774,000 Mercedes vehicles in Europe, regarding the potential software fitted to cheat diesel emissions. In 2019, the International Council on Clean Transportation (ICCT) identified five possible defeat devices that Mercedes could have been using.
Defeat Devices
A defeat device is defined as any element of design which senses temperature, vehicle speed, engine speed, transmission gear, manifold vacuum or any other parameter for the purpose of activating, modulating, delaying or deactivating the operation of any part of the emission control system that reduces the effectiveness of the emission control system under conditions which may be reasonably expected to be encountered in normal vehicle operation and use.
How has the emissions affected drivers
The affected vehicles contained devices by which NOx emissions during testing were reduced as to meet regulatory emissions standards. Higher emissions mean that customers are likely to have experienced an increase in their fuel bills. The performance of these vehicles, general maintenance and running costs are likely to have been negatively affected. Hundreds of thousands of Mercedes-Benz owners in the United Kingdom could have been unknowing releasing illegal and dangerous nitrogen-based pollutant that is responsible for acid rain, global warming, smog and deterioration of the ozone layer.
The current position
There are currently many cases involving Mercedes-Benz fraudulent actions pending in courts around the globe.
